The last thing on a parent’s mind after a tragic drunk driving car accident, which hospitalized their 6 year-old son, would likely be to file a lawsuit. However, a personal injury lawsuit may be the only way for a family to begin recovering from their economic losses resulting from a car accident, including paying for medical bills. The traumatic experience of being struck by a drunk driver would justifiably diminish a parent’s ability to think clearly. Therefore, victims of drunk driving accidents should rely on an experienced drunk driving personal injury attorney here at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates to help guide them through this complicated litigation process.
A 6-year-old San Diego, California boy was severely injured in a car crash that officials say was caused by a drunk driver who had previously been deported from the country 15 times. Lennox Lake was in a car seat, as his family was driving home following a trip to Disneyland, when a truck ran a stop sign and hit their car on the side where Lennox was seated. Lennox was rushed to the hospital with severe injuries, including brain trauma and a fractured skull. His parents were not seriously injured, but Lennox was expected to remain in the hospital for at least another nine days.
The suspect in the crash, Constantino Banda-Acosta, 38, was taken into custody about a mile from the accident scene by Border Patrol agents. He is facing charges of DUI, hit-and-run, and driving without a license. If convicted, he could face almost eight years in prison. Immigration officials say Banda-Acosta had been deported to Mexico 15 times since 2002, most recently in January of this year.
