On November 20, 2011, William J. Finizio Jr. was driving west down Route 80 in Parsippany, New Jersey. Illija Lumbarda was also driving in the same direction on Route 80 when his vehicle drove between barrels in a construction area and struck Finizio’s vehicle. Finizio suffered three tears to a tendon and one tear to a ligament in his left elbow.
According to the Daily Record, Finizio filed a negligence lawsuit against Lumbarda. The jury awarded Finizio $2.5 million for his pain and suffering, disability, impairment and loss of enjoyment of life. Finizio’s lawyer, Gregg Alan Stone, based a large part of his case off of Finizio’s occupation as an esteemed pianist in New York City. Finizio claimed that his elbow injury lessened his ability to play classical music, electric guitar and other percussion instruments. He stated that he was no longer able to play these instruments at the high-level he had previously mastered. Therefore, the accident allegedly had a negative impact on Finizio’s life, diminishing his enjoyment in making music. Several witnesses testified, including Seymour Bernstein, a nationally known pianist, composer and teacher. Bernstein and other witnesses testified to the required hand and arm positions for a successful pianist and how emotion is conveyed through music. Stone stated that this verdict was unusual because the jury was able to understand the importance of piano in Finizio’s life.
