The family of a man killed after being struck by a vehicle while jogging in Wichita, Kansas has filed a lawsuit against the driver of the vehicle and the driver’s employer.
William H. Whiteside, a doctor from Wichita, KS, was on an evening jog in Wichita in April 2012 when he was struck and killed by a car driver by Cody A. Fields. Fields left the scene of the accident, but turned himself in to police the next morning. Fields was criminally charged with leaving the scene of an accident, and he received probation after pleading guilty to the crime.
According to the wrongful death lawsuit filed by Whiteside’s family, Fields was working for Pizza Hut of Southeast Kansas, Inc., when he hit Whiteside with his car. As a result, Whiteside’s family is seeking wrongful death damages from both Fields and Pizza Hut, alleging that Fields was driving negligently and that Pizza Hut contributed to the accident by failing to properly supervise fields.
The defendants, through their attorney Patrick Murphy, have denied the Whitesides’ allegations.
