6 Year-Old San Diego, California Boy Injured In Crash Involving Drunk Driver.

The last thing on a parent’s mind after a tragic drunk driving car accident, which hospitalized their 6 year-old son, would likely be to file a lawsuit. However, a personal injury lawsuit may be the only way for a family to begin recovering from their economic losses resulting from a car accident, including paying for medical bills. The traumatic experience of being struck by a drunk driver would justifiably diminish a parent’s ability to think clearly. Therefore, victims of drunk driving accidents should rely on an experienced drunk driving personal injury attorney here at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates to help guide them through this complicated litigation process.

A 6-year-old San Diego, California boy was severely injured in a car crash that officials say was caused by a drunk driver who had previously been deported from the country 15 times. Lennox Lake was in a car seat, as his family was driving home following a trip to Disneyland, when a truck ran a stop sign and hit their car on the side where Lennox was seated. Lennox was rushed to the hospital with severe injuries, including brain trauma and a fractured skull. His parents were not seriously injured, but Lennox was expected to remain in the hospital for at least another nine days.

The suspect in the crash, Constantino Banda-Acosta, 38, was taken into custody about a mile from the accident scene by Border Patrol agents. He is facing charges of DUI, hit-and-run, and driving without a license. If convicted, he could face almost eight years in prison. Immigration officials say Banda-Acosta had been deported to Mexico 15 times since 2002, most recently in January of this year.

New York City Settles Car Accident During Trial For $4 Million After Jury Finds Total Liability.

Proving fault is one of the most important and crucial aspects of winning a car accident claim.  If a person is found to be at fault and their negligent behavior is the cause of the motor vehicle accident, they can be liable for all the damages caused by their carelessness or recklessness. Damages include both physical and emotional damages, property damage, and even lost wages. However, sometimes liability is unclear, or there is more than one party at fault. When liability cannot be easily determined, a jury sometimes divides fault based on the relative percentages of fault of each of the negligent parties.  In some jurisdictions, if the defendant if found to be 50% at fault, he or she will be liable for 50% of the total damages. In Massachusetts, if the plaintiff is more than 50% at fault, they recover nothing. If you have been injured in an auto accident by no fault of your own, contact our expert Massachusetts car accident attorneys today to get the compensation you deserve.

In 2011, Keisha Baa was driving a van in Manhattan as part of her duties as a home health aide. On this particular day, Ms. Baa was transporting a number of elderly men and women to a local nursing home when suddenly a city sanitation truck changed into her lane. Ms. Baa was unable to avoid hitting the sanitation truck as the incident happened too quickly and the truck was too close to her vehicle. As a result of the accident, Ms. Baa alleged that she sustained serious injuries requiring six surgeries to her wrists, left hip, right knee, right shoulder and back.

Even after her surgeries, Ms. Baa claims to be suffering from severe pain and discomfort. Additionally, she has been left unable to work again. At trial, her attorney Ray Panek, of the law firm Elefterakis, Elefterakis & Panek, sought damages for her physical and emotional trauma, as well as compensation for her future lost earnings. A jury ultimately found the City of New York to be 100% liable for the accident and a $4 million settlement was reached in favor of Ms. Baa.

In 2013, Albuquerque Police Sergeant Adam Casaus was off-duty one afternoon driving in his police issued SUV when he allegedly sped through a red light. He reportedly crashed into a vehicle driven by 21-year-old Ashley Browder who was killed instantly. Her younger sister Lindsay, who was in the passenger seat, suffered serious injuries that doctors say will have life-long effects. Sergeant Casaus claimed he was speeding and ran the red light because he was after a drunk driver. But Albuquerque police investigators apparently did not believe his story and soon terminated his employment. Sergeant Casaus was tried for vehicular homicide but that charge was later reduced to careless driving and he was sentenced to 90 days in jail.

Sean McAfee, the attorney for the victim’s family, stated that the officer was driving recklessly and disobeyed traffic rules “for no good reason.” The City settled with the family for $8.5 million. As part of the settlement, Albuquerque Police will also have to put plaques of the sisters in police stations, show cadets a video about the tragedy, and place bumper stickers on marked units with a number to report dangerous driving.
